1. Operator Information & Acceptance of Terms

The KeyXamathi application and the xamathi.com website are developed and operated by Mr. Burapa Jaiwat as an independent software developer and copyright holder ("Developer", "we", or "us"), based in Bangkok, Thailand (Contact: [email protected]).

By downloading, installing, purchasing, or using KeyXamathi, you ("User" or "Buyer") acknowledge that you have read, understood, and agreed to be bound by these Terms of Service. If you do not agree to these terms, please refrain from using or purchasing the application and remove it from your device.

2. Product Nature & Electronic Delivery (Digital Goods)

Our products consist strictly of Digital Goods (Software License Keys) without physical tangibles:

• Delivery Method: Upon completing an order and confirming payment, your Pro License Key and electronic transaction receipt will be sent directly to the email address provided during checkout.
• Delivery Timeframe: Electronic delivery is typically completed immediately or within 24 hours following payment verification.

3. Pricing, Payment & Tax Status

• Currency & Pricing: Product prices are clearly stated in Thai Baht (THB) or US Dollars (USD) on the checkout page.
• VAT / Sales Tax Status: The Developer operates as an individual sole trader and is non-VAT registered under the Thai Revenue Code. Consequently, prices shown are net amounts without 7% VAT added. Full tax invoices cannot be issued, but electronic proof of payment and receipts are provided in accordance with applicable laws.
• Payment Methods: Payments are accepted via direct bank transfer or PromptPay QR to the official bank account displayed on the payment page.

4. License Grant & Scope of Usage

The Developer grants you a limited, non-exclusive license to use KeyXamathi under the following terms:

• Free Edition: You may use the Free Edition indefinitely without cost for both personal and commercial use.
• Pro Edition: Purchasing a Pro License Key grants you a perpetual, personal, non-transferable license:
  • A single Pro License Key may be activated on up to 2 Mac computers concurrently for your own personal use.
  • You may transfer your license to a new Mac at any time by deactivating the license on an old device within the app preferences.
• Restrictions: You agree not to assign, sublicense, rent, lease, redistribute, publicly share, or resell your License Key to third parties.

5. Intellectual Property Rights

The KeyXamathi software, binary executable files, source code, vocabulary databases, user interface designs, trademarks, logos, and accompanying documentation are the exclusive intellectual property of Mr. Burapa Jaiwat, protected by Thai copyright law and international intellectual property treaties.

You agree not to reverse engineer, decompile, disassemble, modify, or create derivative works of the software without prior express written consent from the Developer.

6. Warranty Disclaimer & Limitation of Liability

The software is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. While the Developer makes diligent efforts to ensure smooth and secure performance, we do not warrant that the software will be completely error-free or compatible with all third-party software or hardware environments.

To the maximum extent permitted by applicable consumer protection laws, the Developer shall not be liable for any indirect, incidental, consequential, or punitive damages (including loss of data or business profits) arising out of the use or inability to use the software.

7. 14-Day Money-Back Guarantee & Refund Terms

We want you to be completely satisfied with your purchase. If KeyXamathi does not function on your supported macOS setup or encounters technical flaws, you may request a full refund within 14 calendar days of purchase. For details and instructions, please review our Refund Policy.

Upon approval of a refund, the License Key will be revoked and the application will automatically revert to Free Edition.

8. Privacy Compliance

KeyXamathi operates under a 100% Local-first architecture. Keystrokes and text inputs are processed strictly within temporary RAM on your local device and are never recorded to disk or transmitted to remote servers. All order processing and website data handling strictly adhere to our Privacy Policy and Thailand's PDPA.

9. Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Kingdom of Thailand. Any dispute arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the competent courts in Bangkok, Thailand.
